    To generate the insightful reports StrataReports is known for, we require you to upload specific documents related to strata properties. Rest assured, the documents you entrust to us are securely stored and protected. Your personal documents are treated with the utmost confidentiality and are not sold or externally shared. Aggregated Data, devoid of personal identifiers, is used to enhance our services and contribute to industry insights, always respecting your privacy. This Aggregated Data, stripped of any personally identifiable information, may be utilized internally or sold to enhance our services and contribute to the broader real estate industry's knowledge base. By providing such documents, you affirm that you have the legal right to share them and that you have obtained all required notices and consents under applicable privacy, data protection, and anti-spam laws from the individuals or entities whose information is contained within. You acknowledge that StrataReports relies entirely on your compliance with these obligations.

    While StrataReports takes commercially reasonable steps to aggregate data and anonymize data, no method of anonymization is guaranteed to be completely irreversible. Accordingly:

  1. StrataReports disclaims all liability for any attempt at re-identification of Aggregated Data or Anonymized Data by third parties, except to the extent that such re-identification results directly from gross negligence or willful misconduct by StrataReports.
  2. Users acknowledge that once Aggregated Data or Anonymized Data is disclosed or licensed to third parties in accordance with this Privacy Statement, StrataReports cannot control the actions of those third parties.

  3. Third-Party Restrictions

    Any third party receiving Aggregated Data or Anonymized Data from StrataReports must, as a condition of receipt:

    1. Not attempt to re-identify any individual, household, or property from such data;
    2. Use the data only for the permitted business purpose for which it was provided; and

    1. was caused by a third party beyond StrataReports’ reasonable control; or

    By using the platform, you agree to indemnify, defend, and hold harmless StrataReports, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

    2. your failure to obtain proper consents or authorizations before submitting documents or personal information to StrataReports; or
    3. your misuse of the platform or of data obtained through it.

    Enterprise User Collaboration: For users affiliated with enterprise accounts, such as real estate brokerages or professional organizations, we may share certain details (e.g., usage metrics or account status) with your affiliated organization for administrative and management purposes. This sharing is designed to facilitate seamless collaboration and account management within your organization.

    Aggregated Data Utilization: To contribute to industry insights and advance the field of real estate analysis, we may use or sell aggregated data derived from your submissions and interactions with our services. This data is thoroughly anonymized, ensuring that no personally identifiable information is included. The utilization of aggregated data supports industry research, development, and the creation of new and improved services.

    Corporate Role Data: StrataReports may collect and use information about individuals acting in an official capacity on behalf of a strata, condominium corporation, or homeowner association (for example, council members or board members as recorded in public meeting minutes).

    1. Corporate Data: Includes a person’s name, title/role, or other details where the information appears in an official or organizational context (e.g., “John Smith, Council Treasurer, Strata Plan 12345”).
    2. Personal Data: Includes private contact details (e.g., personal phone numbers, personal email addresses) or information not connected to the individual’s official corporate function.

    Corporate Data may be used or licensed for purposes such as lead generation, market research, or offering related products and services, provided it is tied solely to the individual's corporate role and not combined with personal contact details unless publicly available or otherwise legally permissible.

    Business-Partner Offers: StrataReports may share or license Corporate Data - meaning building identifiers (e.g., strata name, address, plan #), relevant risk or financial information, and business-contact details such as the name and official role of a council or property-management representative - to carefully vetted third-party professionals (including, but not limited to, building-services providers, developers, and insurance or mortgage intermediaries). The data is supplied solely so they can present property-related offers to the strata corporation. Private phone numbers or personal e-mails are never included unless they are publicly available business-contact details or we have consent. A strata council or manager may opt out of this sharing at any time by e-mailing admin@stratareports.ca with the subject line “OPT-OUT - BUSINESS PARTNER OFFERS”. Opt-out requests will be processed within 10 business days.

    Please note that in certain exceptional circumstances, we may be required by law to disclose your personal information in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.


    Protection of Minors

    At StrataReports, we recognize the importance of safeguarding the privacy of children and young individuals. Our platform and services are not designed for, targeted at, nor intended to attract individuals under the age of 19. In line with this commitment:

If a parent or guardian believes that their child has provided us with personal information without their consent, they should contact us immediately. We will work diligently to remove such information and ensure the child's privacy is maintained.

    Age Verification and Consent: To reduce the risk of inadvertently collecting personal information from individuals under the appropriate age in their province/territory, StrataReports requires affirmative age verification during account creation, by confirming the user's legal age in the respective province/territory. Where a user signs in via a third-party identity provider (for example, Google or AutoProp), we will attempt to verify the user’s age using information available from that provider. If age information is not available or cannot be verified, the user will be asked to confirm their age the first time they attempt to place an order.

    Ongoing Compliance:

    1. StrataReports reserves the right to request additional verification (such as government-issued ID or proof of professional licensing, in the case of real estate professionals) if there is reason to believe an account was created by or on behalf of a minor.
    2. Where verification is refused or fails, the account will be suspended or terminated and any associated personal information will be deleted.

    Handling Mistaken Collection:

    If StrataReports becomes aware that personal information has been collected from a minor in violation of this policy:

    1. The account will be immediately deactivated.
    2. All personal information of the minor will be deleted from our active systems without delay, unless retention is required by law.
    3. The parent or guardian of the minor will be notified where reasonably possible.

    Parental and Guardian Role:

    3. Payment and Billing Records: Retained for 7 years from the date of the transaction, to comply with tax and accounting laws.
    4. Customer Support Records: Retained for 3 years after resolution of the support matter, for quality assurance and dispute resolution.
    5. Aggregated/Anonymized Data: May be retained and used indefinitely, provided it no longer identifies any individual or household.

    Trigger Events for Deletion

    1. Account Deactivation: Personal information associated with your account is flagged for deletion and securely deleted within the standard retention period.
    2. Withdrawal of Consent: Where legally permissible, data processing is discontinued and Personal Data is deleted within 30 days of your request.
    3. Legal/Regulatory Requests: If deletion is mandated by a regulator, court, or statute, data will be deleted promptly in accordance with the order.

    Exceptions - “As Necessary” Retention

    In limited cases, StrataReports may retain personal information beyond the standard retention periods where:

    1. Compliance: Required to meet statutory or regulatory obligations (e.g., records retention under corporate, tax, or securities laws).
    2. Litigation or Dispute Resolution: Necessary to establish, exercise, or defend legal claims.
    3. Fraud and Security: Retained to investigate or prevent fraudulent transactions, unauthorized access, or misuse of the platform.
    4. System Backups: Information may persist temporarily in encrypted system backups for up to 90 days after deletion, after which it is overwritten.

    Data Retention for Specific Purposes

    Deletion of Inactive Accounts

    In the interest of efficient data management, we may also periodically review and delete inactive user accounts and the information associated with them. It's important to note that the deletion of your personal information may result in the loss of access to our services, and we may retain certain information as necessary for our legitimate business interests, such as fraud prevention and enhancing users' safety and security. Aggregated or fully de-identified information, which no longer identifies you, may be retained indefinitely and used under the licence granted in our Terms of Use.


    Consent to Commercial Use of Submitted Data

    By submitting, uploading, or otherwise providing any documents, information, or data (“Submitted Data”) to StrataReports, you acknowledge and agree that:

    1. StrataReports may use, process, analyze, adapt, and combine Submitted Data with other information to create new products, reports, and analytical outputs (“Derivative Products”);
    2. StrataReports may sell, license, or otherwise provide such Derivative Products — including those containing information about strata corporations or other properties — to third parties, such as insurance brokers, lenders, and other service providers, for their commercial use;
    3. Such use may occur without further notice, approval, or compensation to you; and
    4. You have obtained, and are solely responsible for obtaining, any and all consents necessary under applicable privacy and other laws to permit this use, including from clients, property owners, strata corporations, and other affected parties.

    This consent is in addition to, and not limited by, the rights granted to StrataReports in any other section of this Privacy Statement or our Terms of Use.

    Consent to Data Practices and the Right to Withdraw Consent

    By engaging with StrataReports and utilizing our services, you acknowledge and consent to the collection, use, and disclosure of your personal information as outlined in this Privacy Statement. We are committed to respecting your choices and ensuring that consent is freely given, informed, and easy to withdraw.

      2. Notifications will describe, to the extent possible: the nature of the Breach, the information affected, the steps taken by StrataReports to mitigate potential harms, and measures individuals may take to protect themselves.
    3. Regulatory Notification

    Access and Correction, Deletion Rights

    3. Other Countries (including Asia-Pacific): Transfers are made on the basis of SCCs or equivalent contractual safeguards, requiring the recipient to implement security and privacy protections substantially similar to those in Canada.

    Risks of International Processing

    While StrataReports requires all service providers and partners to safeguard your information, differences in foreign laws mean:

    1. Privacy regulators or government authorities in those jurisdictions may lawfully access your information without notice to you.
